论著作权制度对技术措施的保护

中文摘要

在著作权人和公众利益之间实现均衡是版权法的价值所在。技术措施法律保护问题本质上是传统著作权法下的利益均衡在数字化、网络化条件下被打破后产生的一个特殊问题。数字技术和互联网时代的到来,极大的改变了人们的生活方式,也对著作权制度带来挑战。一方面,著作权人在面对疯狂的盗版行为时往往得不到有效的救济,需要通过技术措施加强其对作品的控制力;另一方面,作品被施加技术措施之后,合理使用等传统著作权规则却又受制于技术措施本身及其相关的保护立法。继世界知识产权组织揭开的技术措施法律保护运动之后,如何在新的时代环境下实现著作权法倡导的利益平衡宗旨,成为世界各国知识产权界讨论最为热烈的话题之一。
本文从研究技术措施的概述出发,在总结技术措施的概念、种类及保护的必要性和合理性基础之上,通过比较分析的方法,对国际条约和有关国家立法进行研究,并采用理论分析和案例研究相结合的方法,揭示了技术措施法律保护的限制问题,最后在利益平衡的理论基础上对完善我国技术措施法律保护提出了立法建议。
全文分为四个部分:
第一章:技术措施的概述。根据目前国外立法和国际条约,概括地介绍技术措施的基本概念和种类,并在数字技术和互联网迅猛发展的背景下,系统的回顾了保护技术措施立法的发展过程。同时,详细阐述了为技术措施提供法律保护的必要性依据,并从激励理论和经济分析的角度对技术措施法律保护的合理性基础进行分析。
第二章:国外有关技术措施法律保护状况。采用比较分析方法论述了国际条约和有关国家的技术措施立法状况,在结合案例分析的基础上,研究目前技术措施受著作权法不同保护程度的立法模式,为后文完善我国的法律制度做铺垫。
第三章:技术措施法律保护的限制。本章分为两小节:第一节,从著作权权利限制制度、表达自由以及公共利益等方面,分析了当前技术措施的立法保护与相关利益之间的冲突,指出了在著作权法领域存在的著作权人权利过分扩张、甚至滥用权利的倾向,所以立法需要对保护技术措施给予必要的限制。第二节,结合当前比较成功的立法经验,总结了为技术措施法律保护给予限制的方式,包括设置例外规定,建立新的例外审查机制,以及为权利人设定相应的义务,这也是本文的重点。
第四章:我国技术措施立法的现状及完善。本章在阐述我国的立法现状和司法实践的基础上,列举了我国有关技术措施法律保护的不足之处。最后,以坚持利益平衡为立法思路,借鉴各国立法经验,针对我国知识产权保护的实际状况,提出完善我国技术措施著作权保护立法方面的建议。

Abstract

The value of copyright law lies in the balance of the interest of copyright owner and public interest. The issue of the protection of Technological measures with copyright law, in essence, is an issue arising from the breaking of the balance of interest under traditional copyright law by digitalization as well as internalization. The arrival of digital technology as well as internet times have greatly changed people’s lifestyle and in the mean time, imposes a great challenge on the system of copyright law. On one hand, with rampant pirating, copyright owner can’t be appropriately remedied and he needs to apply some technical measures to strengthen his power of control over his works; on another hand, when technological measures have been applied to works, traditional regulations of copyright, including Fair Use are restricted by technological measures together with other concerning legislation. After the legal protection of technological measure campaign initiated by The World Intellectual Property Organization, how to fulfill the objective of the balance of interest advocated by copyright law under new circumstances becomes a heated topic amongst people in the realm of Intellectual Property in each country throughout the world.
Based on the summarization of the concept, category, the necessity and rationality of the protection, with the method of comparison analysis, the thesis starts from the primary category of technological measures and looks into international treaty and legislation of related countries. Besides, with the combination of theoretical analysis and case study, it uncovers the limits on the legal protection of the technological measures in a bid to make suggestions on how to improve legislation of technological measures on the basis of the balance of interests. 
The paper is composed of the following four parts.
Chapter 1:The brief introduction to the technological measures.
In light of current legislation overseas and international treaty, it briefs the basic concept and category. Under the circumstances of the rapid development of digital technology and internet,it systematically retrospects the legislation process of the application of technical measures. Meanwhile, it expounds why it’s necessary to provide technological measures with the protection of copyright law and analyses the rationality on the basis of the theory of stimulus and economic analysis.
Chapter 2:The current state of the application of legal protection on the technological measures overseas.
It illustrates legislation on technological measures and international treaty on the basis of comparison analysis. With the method of case study, it looks into the legislation paradigm of the protection on technological measures with copyright law according to different scales and makes preparation for the discussion on how to improve legislation in our country.
