结论

本文深入分析我国解雇保护制度的立法现状,揭示我国现行解雇保护制度的不足,并通过对比的研究方式以相同的视角考察日本解雇保护制度,后立足于我国具体国情的基础之上,提出完善我国解雇保护制度的建议。

解雇保护制度建立的前提是要尊重市场的调控机制,在此基础上倾斜保护劳动者。我国的解雇保护制度尚不完善,需要借鉴完善的地方还有很多,但在倾斜保障劳动者劳动权、生存权的同时,必须关注法律规范对用人单位解雇权限定的“度”,过多的公权力干预可能反而会激化劳资关系,使劳动力市场流动性变差不利于用人单位的发展,这对保护劳动者的劳动权,平衡用人单位经营自由,维护劳动力市场秩序具有重要意义。

本文对日本解雇保护制度的借鉴中,是从解雇事由、解雇程序、解雇救济三个维度对比研究并提出倾斜保护劳动者,加强对用人单位行使解雇权的限制的建议。本文主要从劳动者角度提出解雇保护制度的完善,忽略了对用人单位解雇权基于经营自主权方面的考量,以后需从用人单位的方面平衡劳动者与用人单位的利益,完善的解雇保护制度,构建使劳动者和用人单位实现双赢的制度。
