二十一世纪以来，一些学者利用国际法宪法化描述了国际法的发展趋势，对于国际宪法化思潮在学术界兴起，相关研究的蓬勃发展，也有许多已经出版的书。在国际经济法领域，宪法化已成为主要话题。诸如杰克逊，彼得曼，乔尔·特拉克曼等学者都提出了“国际经济法宪法化”或“WTO宪法”等观点。然而，其他一些学者却不同意这种观点，Jeffrey L.Doffoff教授认为这是一种“宪法化幻觉”。
Since the 21st century, some international law scholars use constitutionalisation to describe the development trend of international law, a trend of thought in regard to international constitutionalisation has risen in academic circles, and relevant researches grow vigorously, also a lot of books have been published. In the field of international economic law, constitutionalisation has already become main topic. Scholars such as Jackson, Petersman, Joel P. Trachman etc., all put forward ideas such as “international economic law constitutionalisation”  or “WTO constitutionalisation” ; however some other scholars do not agree with such ideas, professor Jeffrey L. Dunoff just think it is an “illusion of constitutionalisation” . 

然而，从价值观的角度来看，或者将国际法视为社区法，国际法具有宪法化的发展趋势。然而，国际社会本身的结构深刻影响和限制了这一趋势。从各个角度来看，很难深入思考这种趋势;然而在这篇文章中，它正在试图讨论国际法的“宪法化”是什么意思，以及在这种情况下的价值观。However，from the perspective of values or just think the international law as community law, the international law has a development trend of constitutionalisation . Nevertheless, the structure of the international society itself has profoundly influenced and restricted such a trend. It is hard to address such a thought of trend in depth from all perspectives; however in this essay, it is trying to discusses what “constitutionalisation” of international law means, as well as its values in such a context.

The famous international constitutionalist Nico Krisch think that, although the   sovereign states is still the most important international social actors, the country is under the guidance of the international community norms to act , even without the will of sovereign states, or even a sovereign state opposition, the international community will still provide some basic value protection.  State sovereignty is not just a function of the inherent serve to protect the basic human rights of its citizens, but as a whole to serve the protection of human rights for all mankind. In other words, the state is one of the international communities to realize the core value of law tools. In Nico Krisch view, the domestic constitutional right forms the basis for the operation of domestic public power, and these rights constitute universal value of international, now through the international human rights form confirmation, with the presence of independent status in domestic law..............
