网络犯罪的基本形式及其防范措施
The Basic Styles and Countermeasures about Cyber Crime
摘 要
随着我国市场经济的深化和信息社会的迅猛发展，网络犯罪日益盛行。本文首先阐述了网络犯罪的概念及类型，并深入分析了网络色情、网络欺诈、网络赌博、网络洗钱、侵犯知识产权、等五种网络犯罪的基本形式，在多方面分析了网络犯罪的特征之后，本文认为，目前我国饿法律还缺少网络犯罪的先关新罪名，刑事责任年龄可以适当降低、单位犯罪以及共同犯罪的情况还需细化，并以此提出了相关建议。
关键词：网络犯罪；基本类型；防范措施
Abstract
With the development of Chinese market-oriental economy and the information society, the cyber crime increase rapidly. This paper expounds the concept and types cyber crime, and in-depth analyze basic forms such as online pornography、internet fraud、money laundering、internet gambling、network infringement, and discuss about the network crime violations of the object, the network crime objective performance, the main characteristics of the network crime and subjective manifestation of the network crime, and then ge some countermeasures such as add the new charges, enhance criminal responsibility, the perfect, perfect the unit crime and joint crime.
